Can I Junk a Car With a Lien on It

    I have a rather stupid scenario.

    I have a car with a lien that I would like to junk. The lien is held by an out of state bank, and is on a loan from my wife's ex-husband. He took out this loan against her car (she is the only one on the title/registration) AFTER they were divorced, so I think it is probably illegal anyways. (Good 'ole boys type of local bank let him do it)

    I don't really care about that, I just want to know if I am legally required to 'hold' this car in my possession until the lien runs out, or if I can just junk it and be done with the whole mess. It hasn't been registered in probably 3-4 years, and has been sitting in my garage since.

    I am in Wisconsin, and the car lien/registration is held in Kentucky.

    A: Yes. You can do this right after you pay the lien.

    Have you seen the title?

    The bank told me my wife is the only one listed on the title. I do not have the exact date of the lien, except that it was after they were divorced.

    Who told you that the ex-husband got a loan using the car as collateral after the divorce and even though he was not on the title?

    My wife told me about it initially, as she was notified about it at some point. Then, after talking to the bank, they confirmed the name of the lien holder (him).

    Good old boys or not, banks are not allowed to do what you said they did.

    So, this bears investigation at the bank.

    (Your wife will have to be the one getting the info; they won't give it to you.)

    First off your title of the vehicle should state any lien holders against the vehicle. If you do not have the title then you can go to the DMV and file for lost title. You can also ask them if there are any liens against the vehicle. Actually your wife would have to do this for you.

    Now if the title comes back clean with no liens on record. Then you can do what ever you want with the vehicle.
